Weird situation - I need help ....

there is a person in us who has the same name and dob as me. i know this because we had been assigned the same ssn. anyways we had resolved that and are facing more issues.
1. 2 months back i received a EAD with my personal details but a different A number and snap. i knew what was going on and returned the EAD .
i figured that i had applied for a change of address ...so INS updated all petitions with the same name and dob. the other person is a student and this was his OPT EAD.
2. the other person then called INS to update his address so that he could receive the EAD.
now today i found out that the address on my I485 has been updated (it is the other persons address)...

before i do anything i wanted to consult u guys to see how best to handle this. what should i do ? i think our files are different and the issue is just at the software level. pls comment.
 
I'm surprised you did not do anything when you found out you and another person share the same SSN. SSN is like a national ID; no 2 people have a same number.

I don't know who got this SSN first, but one of you need to get a new one.

This may be an identity theft.

I have already resolved the SSN issue 2 years back. He got a new SSN. It was not an idntity theft issue but mistake of SSN. They got confused since he had same name/dob and so gave him same ssn.

Now the issue is that it seems like INS address system goes off name/dob too. so everytime i update address it updates his address too and same happens when he does it. my lawyer says just update the address and dont worry since it might be tough explaining the issue to INS.
 
Your lawyer's suggestion is not helpful. I would worry if somebody with the same name and the same dob gets my EAD or green card.

Even it's tough, you should explain to the customer service to make sure they update only your info when you request, and they update only the other guy's info when he requests.
 
Your lawyers suggestion seems very lame. Yes surely it will be tough explaining the issue to INS, but the bottomline is the issue needs to be explained to them.
Else this will keep going on and then suddenly something bad may happen with the other person's application and then you might get into trouble.
Your lawyer is probably asking you to take is easy because its only a address problem. But this has a potential to boomrand into something big. I have no clue if anything can be done other than just making sure everytime that your information is correct with the INS.

Or if you want to play it safe change your name or just change the spelling in your name. Probably will spare you any unforseen problems in future. I know changing a name is very personal issue but if there is no other way then.....

2. I plan to write to CSC abt this. do u have an idea which address i should use ?
3. i would think that same name/dob is a common thing. is it not ?

Yes changing name is a hassle. You need to weight which is a bigger hassle. Changing the name (just spelling) or the unknown hassles that may be potentially possible.
But again changing name is really a huge hassle. You have to advertise both in a US daily and in a daily in your home country. This is only the begining. Then the name will be changed in the passport then the SSN and then probably your 485 application.

I dont know, probably talk to a different lawyer, there should be some easy way out.
