Weird RFE. What to do. Please !!!

RFE details

1. The record reflects that you are working and living in State X and that your spouse is currently living and working in State Y. Please clarify.

2. name and location of employer, date you began employement.
3. Employement letter

What should I provide to clarify beside submitting Tax filing, marriage certificate, bank statement, baby birth certificate.

Please advise.
 
I know of cases who got their 485 approved where husband and wife were working in two different states. Not sure why thye sent this RFE just for the heck of it.
 
Looks like INS has some doubts about your marriage so show them proof that you both are married and live togeather and show them any evidence that will make them feel you are really married, not making it up just for GC.

Yea whatever RM said .. plus show some compelling reasons as to why you guys are not living together (but still together) .. I'd say .. include marriage photographs and stuff also .. just prove that your marriage is authentic 100% ..
 
Thank you all

After reading so many rfes and with my experience, I want to submit the following docs to INS(through Attorney)

1. Marriage Certificate
2. Tax filings(filed jointly)
3. Baby Birth certificate who is less than year old
4. Letters from both of us saying that we are wife and housband still.
5. Bank account saying that we both have common account for last few years

Do you guys think of any thing. Please!!!!

Another point is that after baby delviery, my spouse is staying with me and working from home. Employer is ok with it. In that case do we need to do address change with INS. But my spouse is still keeping that previous place for all communication and to stay while visiting employer.

I would say consult your lawyer first. Submitting too many documents might not be as helpful as submitting the necessary documents only.
 
and just reminded another RFE somewhere else I saw - an NIW case: Prove your death is a loss to national interest.

INS sucks.
 
besides the proof, make sure you also submit a letter addressed to the officer explaining specifically the circumstances.

if you guys are living together and have both spouses names on aptmt lease or if you own any property, asset or anthing else together here, try to include that.

if this 485 is employment based, you should not have to be too worried.

please suggest these to your lawyer and take actions based on what your lawyer says.
