Weared situation, please help

Hi,

My company had a fight with the attorny after my 140 was approved. Now the 140 approval is with him.

I had opted for CP in 140. If I call NVS and ask them to remove the attorney and send communication to the company directly what problems I may face?

At what point of time I need my 140 approval notice. Do I need 140 approval notice with packet 3 or at the time of interview?

Please help.

You have legal rights to get all the docs for your case from your attorney in good condition and understanding. Your company attorney has to give you all the docs for your case. If the attorney doesn't do it by itself, please request.

You will face no problems. It is your legal right to add/remove an attoreny from your file. All the future correspondences can come to you or to the new company's attorney. But this not automatic. You or your company will have to make the move.

You technically don't need the I-140 approval notice after your case has been sent to NVC. But it's nice to have it with you, for just-in-case type of situations..

I was in the same boat.... But I have good news for you.

First tell me.... When was your 140 approved ? Because it takes about 60 to 90 days for your case to be sent to NVC. Then after that they will send you a letter confirming your option of going for CP over 485.

NVC will not entertain your calls untill they have received your case and have created a file on their records.

Once they have received your file and created a case for you then at that time you need to call them and tell them that you would like to remove the Attorney on file. They will ask you to fax this request to the attention of the representative you will speak to. Then give about 2 days and call back to confirm that they have received your fax and the necessary changes have been made.

I am saying this confidently because I had to do the same thing. Now make sure that in the letter you fax you mention to remove your attorney on file and have them contact you directly and give them your contact information... address etc. for any further perusals.

All the henceforth correspondence would be done thru you. And let me tell you... Everything from hereonwards is simple and you can easily handle yourself.

And.... You do not need 140 approval (original), but atleast a photocopy or a fax would be good for your records.

And one more thing.... Do not tell your Attorney about this... Just do it when the time comes without notifying him. There is nothing he can do.

My case reached NVC on 10 March, yesterday when I called about the attorney removal, the lady told me that I have to send the letter only by mail and Fax does not work.

Is it true, can somebody give me the fax number if you have?
How much time does it take for them to issue reciept?

When contacting be sure to always include your case number.

If they have said, they do not respond to faxed requests, then
send a letter through mail.

Try calling again and ask if you can fax this request. "BECAUSE" as I already mentioned that you need to fax it to the attention of the representative you spoke to.

If they say that they need a letter then you can might as well send a letter.... It will take probably 2 to 4 days to get your letter there..... You can even express mail it if you want.

this form is to be sent to NVC (address quoted by dineshgk)

This form is to officially change/remove the attorney for case related communication purposes.

Letter Sent and Received

The letter was sent yesterday by Air-Bornie with today's morning delivery. I believe it might have received today.

I will try to talk to someone tomorrow to varify the same.

The realy fear is if they sent the reciept to the nasty layer he will just hold it for ever and make a mess.

Also I can have the form you have suggested with the second option checked which is
"I do not appoint an agent or an attorney to receive mail about my application. Mail from the U.S. Department of
State concerning my immigrant visa application should be sent to me at:"

I will definalty call tomorrow.

You guys are of great help.
