We filed seperate tax return. Will that be a problem?

AOS but filed seperate tax returns. Will that be a serious problem?

My husband is US citizen. I 'm F1 student. We married last year, and I applied AOS recently. My husband is my sponsor. But we filed seperate tax return (married filling seperate) for 2004 and I submitted his tax return in my application package already. the reason is because two years ago his child support was messed up by his ex-wife and they said he owes 8000$+, they then made a deal with him and asked him to pay 60$ extra every month. All his federal and state tax returns money were taken by goverment since then. So we decide not to fill together or we will lose more money. We probably will not fill jointly for a few more years until that over due is clear. Will immigration officer find this and give me more trouble? Any advise will be highly appreciated.

It is recommanded that you file a Joint Return if you have filed for AOS but not necessary. If you have enough evidience to prove that your marriage is in good faith then I don't think it is going to be a problem. Do you guys have joint bank account, joint utility account, credit cards, lease/morgage on both of your name. If you have 'Yes' on most of this, you are fine.
