Update from USCIS Oct 2006 bulletin about backlog reduction of pending applications.

USCIS is indicating that out of 2.7 Million backlogged cases 1.15 million cases are being held due to an agency outside of USCIS such as FBI.

The intent of Presidant to reduce the backlog was to releive those stuck in backlog from the sufferings. The statement by uscis indicates that for 1.15 million people the suffering will go on. Just that its not because of them but from some other agency which in turn is part of Department Of Homeland Security.
This clearly defeats presidents intent !
and i bet there is some under table agreeement betweein USCIS & FBI to deliberatly held some cases to show USICS improved numbers. Otherwise tell me this : If i can get my H1B visa stamped outside USA , whcih requires state dept to conduct some security check, how come USCIS is even investigating be for security background check?
 
Retro cases are not considered backlogged ..

The USCIS does not consider cases held by other agencies or those that are retrogressed to be backlogged. This policy is in their best interest. It makes them look good. So long as the blame can be shifted to another agency, everything will work fine. The USCIS blames the DOL who blame the politicians who blame the immigrants. The USCIS also blames the FBI and the FBI blames the politicans for inadequate fundind. Each party knows who to blame and ultimately there is no one that can be pinned with the blame. I am sure a lot of us play these games in our workplaces as well so we shouldn't be surprised.

do u think when the official publication comes out in jan 2007, we can figure out how exactly the 140K visas were distributed, and which categories/ countries got how much of that 140K. ?

and hence predict what it will be for 2007.

That's a good and humoures responce. I agree that blame game ( or SYA - Save Your Ass) type of policies that most of us use at work.
Do you see what USCIS is saying though ? Is indicating 50% of cases are pending i.e. 1.15 million people suffering though USCIS has met the target.
I havent met anyone at work who is off target by as much as 50% & yet gets the Presidants kudos!!!!! and this is happening within government of worlds only remaining superpower.

The official publiciation should atleast show us if all 140k visas were used. However I am not sure what good that will do. There is nothing we can do if visas are left unused. It will only show us that this process is hopeless.

These cases can NOT be approved because PD is not current. To me, these cases are not backlogged cases.

Technically and by the law u are absolutely right. From the perspective of lawyers and other "technocrats" there is no denying the fact that retrogressed cases are not backlogged. However, have the thousands of cases sitting in the Service Centers for several years magically disappeared due to retrogression? The cases are still there and they are pending. We can choose to call them backlogged or pending or nothing at all but all those terms do not change the situation on the ground. Why I found this whole thing amusing was the way my case went from being backlogged for over 2 years to not being backlogged at all. Retrogression has been such a savior for USCIS and DOL. All of a sudden, USCIS has met the federal mandate of 6 month processing times, never mind the thousands of cases that are now "technically" not backlogged. I do not want to start an argument based on the laws because I agree that I do not have a leg to stand on but any reasonable person will find the interpretations and implementation of these laws to be totally ludicrous.
