My case is little different. I am on H1B since 2007 and was working till the end of 2008. I was going to my country on vacation on December 2008 for a month. Right before my flight, I got a DUI. Asked the judge to postone my court date. Judge agreed. However when I went for stamping, it took me few months to get the visa. My employer told me that I could work from my home country using the remote log on.
Then I got married and with my DUI case, my lawyer told me that the case has been inactive and no further processing would happen until I return back to the US.
For the next 18 months until June 2010 I was in my country but I had to leave due to the fear of prosecution etc from a political organization that was/is active. I'm not really political but however I was just targeted randomly because I happened to come into argument with a local who happened to be from that political organization. I'm from a middle class family back home and they found out that I work for an American company and started asking me for money which I said, I won't give. I got phone threats from different cell phone numbers and I compalied that to the police as well as municipality. They had used VOIP number which was not possible to be trapped, thats what the police told me. I didn't know what to do and after that since security was a concern. I had no plan to come back here and continue to work there, even my extension for H1B is pending, however I want to opt for asylum as I don't want to return back to my country. Do you think I have a valid reason? I'm not yet out of status and my wife recently has joined me. Its been 3 months since I'm back here.
