Waiting for Oath.

I had my citizenship interview on 7/31/2007. Passed the interview questions however because of a name difference between my birth certificate and my application/green card, the officer had told me that we need to do a name change. Fine by me, I signed all docs for the name change petition etc. The officer told me that a written decision will be mailed to me. N652 did not have the 'congratulations' box checked.. 2 1/2 months down the road I have not heard anything. My wife, who had her interivew on same day completed her oath in september and even got her passport.

I did an infopass today to see what is going on...to my surprise I was told that they are re-scheduling me for second interview. This came to me as a shock. 2nd interview for what? I asked this to the officer today and she said 'no clue'..That was it, and my dilema is even more now. The service center is Houston.

Anyone out there in same boat? Is a second interview a common occurance? I am wondering if I should get a lawyer at this time.

Please respond...any advice will be appreciated.

Well recomended for the Oath after the first interview just means that you are being recomended. So obviously in the final checks something wasn't adding up. Was there anything questionable during your first interview? Too many days outside the US, some previous conviction of a criminal offence etc? Seems they just might want to verify something that they are questioning.

Now the other thing it could be is the Infopass person mis-took the oath as the 2nd interview and it might be that you are actually being schedualed for for that. Just wait and see what might come up, but generally they might want to review something unusual in your case again...
 
It might be a mistake on the officer's part. Maybe they didn't read correctly. Hopefully though, if it is a second interview, your case will be approved right away. Good luck.

Apart from the issue the officer had noted with my name on GC (when compared to BC), there was really nothing else that sounded unusual to me. She even assured me that 'do not worry if you get a letter with your BC name on it, your Naturalization cert. will have your correct name'. I remember asking her about the delay involved because of the name change and she had told me that it depends on background check. I am not sure what she meant by that, but I am wondering if my process in stuck in that check.

That could be it then. INS people don't always talk to one another so the ones that got your recomendation might not have seen a note about the difference in names from the BC and GC and they might have gotten confused and thought it's not the same person.

I think it's probably just to clarify the difference up of what the names are different or something...
