Waiting for I485 approval and have stampping in passport of H1B of new company ????

Hi,

Please direct me right.

A company filed for my GC. Through which I140 got aprooved in Sep 2003 . I have applied for I485 in Sep 2002. Have received EAD card also. In Oct 2003 I got renewed EAD card also ( for Nov 2003 till Nov 2004 ).

Decem 12 2003 was my last day with company A.
In the end of Dec 2003. Company B files for H1B ( Primium processing ). I went too india in the end of india, Company B send me approval notice of H1B to india , I went with it for stampping. Came back. So at present on passport I have company B H1B visa. after I came back Company B is looking for woek for me and so do i. I have found myself ome good project.
that company is telling to work indepandantly on EAD.

My doubt is on passport I have latest B company H1B visa stamp.

1 Can I still work indepandantly as i am hearing from friends when I will get final I485 approval and will go for stampping of passport to get GC. They will ask u B companys pay stubs and all. As they will see last B companys h1b on passport and if i work indepandantly i will not have pay stub from company B


2 What is better way of handling this situstion ??

1. If you file w-9 with the new company with EAD as your work authorization document and if you have a letter from company C (the one asking you to work on EAD) describing the nature of duties , salary and title of the position -similar to the one described in LC/140 you dont have to worry. Recent paystubs are enough.

2. I would contemplate informing BCIS about your exercising AC21 portability provisions. Consult a lawyer.
