Hi everyone,
I have a question that really matters to me, hopefully, someone can help sharing suggestions or recommendations on it.
My employer applied for employment-based concurrent I-140/I-485 for me under EB2 category late-August this year. It is already December but the I-140 has not been approved and can take several months at best to wait. We only did the fingerprints last month.
Earlier this year my wife won 2011 DV lottery and the number (15,xxx) is already current in December. We should probably have waited and applied for DV instead of EB which took place before.
Should we keep waiting for EB AOS to continue or ask the attorney to withdraw the AOS and re-apply under DV? I really worry that EB route may be harder and result in RFEs or denials based on various reasons (job category, education, taxes, etc.). DV Lottery is a more guaranteed and safer path to greencard.
What does it take to switch the EB AOS to DV-based one? Do we need to resubmit all the AOS paperwork, including the medicals, etc.?
Most important, if we ask to withdraw our EB-based AOS before applying for DV AOS, what status are we in between?
