Waiting for EAD over 120 days---Pls Advise

Hello,
I applied for my EAD And AP during first week of November.I got the receipt notices.But I did not recieve EAD and AP yet.

There were LUD's on EAD AND AP in february but nothing after that.

What does it mean?


PLEASE SUGGEST/ADVISE

I filed my EAD and AP @ VSC.


I got the receipt notices but nothing after that..

First make an infopass immediately to your local office and request them to contact the center where sent in the application for them to expediate your application.beyond 90 days they can send that request. When you make infopass elect option interim EAD.
Second also contact your congressman office and request them for help.
Fill out thier form and they will do thier best.

Can I take infopass appointment in any state or same state where I reside?

Normally you should go to the closestUSCIS office where you reside.( some even go to the office close to thier work place. that you can explain.
But if you are temporarily out of your you can always take a chance if they help. I am not sure about that.

No format. Just go the http://www.house.gov/
Find your congressman. Go to his site and find casework help.
Rest just keep following instructions fill out the form if any .Fax the paperwork to them.
I would drop it off personally and meet the liason officer for immigration help over there. will get you action quicker.
 
I was in a similar situation. I had taken a INFOPASS appointment. When I went to the USCIS office, they said they will send a request to the Processing Center. One week later I called the USCIS phoneline, and was told that they will be sending an expedited request to process my case as it was more than 120 days of filing. In two weeks, I got my EAD.

Carry all copies of EAD application receipts. If you have done Finger prints or Biometerics for EAD , carry that, YOur passport . thery can ask for anything.
All carry Receipts of your I485 also.
Your State Photo id like a Driver Lic.
A magazine or a book beacuse you might have to wait :)

My EAD took near 6 months to be issued! I had 5 infopass appointments and 10 calls to the 800number! they just said we are doing background check! It was finally approved after 6 months and after my company paid $5k for an expedited H1B application to bring me back to work!!!!
 
IO advised to bring a job offer letter

It is about 118 days since my wife applied for EAD. We went to infopass yesterday. The immigration officer advised that EAD has been pending due to background check, and that she should bring a job offer letter stating that she will not be allowed to work until she has employment authorization. Then they can request expedited processing of the EAD.
I believe there is an statute specifying that USCIS will issue EAD no later than 120 days. Don't remember where I read it.

Mahek: I am currently on H1b but applied for Green Card (and EAD and AP) through my wife on December 5th 2007. There were LUDs on my 765 and 131 on Januarty 8th, 2008, but nothing after that. No activity, no approval, even though it's a bit more than 90 days. Everybody else with my timeline had been getting their EAD and AP in a matter of weeks, so I am myself quite worried about that. Not sure if it's an anomoloy, or it's standard for everybody who has to go through background checks. Until now i didnt believe that EAD and AP had to wait for background checks, but maybe they have to?

Hi: I had applied for ead and it was over 90 days, I went for info pass and asked for temp ead card, and they made it righ taway, but it was only for 90 days, i think it the law( but i am not sure) that if ur ead application takes more than 90 days you can apply at you local office for temp card. but plz double check it from attorny, but i am telling you about my case.

Found the relevant statute

8 CFR 274a.13(d)
USCIS is required to adjudicate a pending Form I-765 within 90 days from the date of receipt. Failure to complete the adjudication within this time frame requires the Service to grant an EAD for a period not to exceed 240 dyas.

We have not taken infopass appointment yet.

But in my opinion its good to be honest with the officer about your sitiuation.

Be patient.
