waiting for 140 for 13 months

my company applied for I140 in Feb 2002 (WAC02111). A RFE was received and responded to in July 2002. The case is still pending..Lawyers says security check..

In the meantime, applied for I485, EAD and AP in October (ND Oct 22, 2002)...finger printing is done but EAD and AP are still pending..

Went and got an iEAD from SJ last week and now I have a quesiton...If I changed jobs after 180 days using AC21, and I140 is refused for some reason..what is my status? Is it better to change job using EAD and also apply for H1 transfer? can someone change if I140 is rejected from AOS to H1?

any pointers will be helpful

If your I-140 is denied you will be out of status. If at all possible stick with H-1B. Also remember ther's a lot of confusion about using AC21 when one has filed I-140 and I-485 concurrently.
