WAC-02-139 series and a question

I am in WAC-02-139 series. ND is on April'2002. I see posts here with folks getting their AOS approved with WAC-02-145 and also WAC-03 series(I am not talking about concurrent I140/485)!!!

How can it be possible?I called BCIS about that - they say it must be because of "expedite" situation. They must have made "expedite" requests. Since the BCIS priority date is end of Jan'02, I can not even make "expedite" request. I am sure there are other people in this board who has the same question.

Can anybody provide any clue whats going on?


Another question I have: my EAD is valid till Jan'05 . If I change my job now, can my employer revoke my 485 application? Can my employer revoke my GC application for any reason??
 
BCIS/INS is called the worst US agency for a reason. this agency is run by complete morons.

485 can only be revoked by you, your employer can't revoke it. But, the employer can revoke I-140. There has been a rule that if your I-140 has been approved and you are waiting for adjucation of your 485 for over 180 days, this revocation of I-140 will not adversely affect your I-485.

don't worry, all this expedite cases and pilot programs so far covered no more than 5% of applications. I understand it is annoying when someone who's behind you in line gets GC earlier, but, generally, USCIS sticks to the FIFO rule. (see the graph here ).
They are not morons, they are just underpaid and overworked.
As long as you can keep your job and related papers, like EAD, APs solid and sound , you are safe.
 
Well it is a matter of time, just a question of how much time? We can reduce the time period by making sure that INS remains focused on our cases, keep the pressure up and they will have to make good on the promises they make with such regularity and never keep.

400 approvals in Feb is a good sign, looking for more of the same in the future.

The worst thing that can happen to me now is getting an RFE while my employer outsources my job to India :-)

I guess I have 3 months to find a job and reply to RFE through new employer. Thats the only thing which is keeping me nervous at this point.

I am getting tired keeping up with all equations for the past 3-4 years. But I am feeling stronger with my EAD in hand till beginning of 2005.

I understand everybody is going through the same ride - its painful. But we gotta get it.

After getting our GC we have another fight in hand - "outsourcing".

I am getting more frustrated seeing your 485 approval
statistics :-)

They touched all except 139 series :-(

So its not a FIFO. They must be using some crazy algorithm or they must be using some buggy software which was never tested.

Is there anyway we can write some petition asking why this anomaly?

It seems to be an infinite loop..................

BTW - my BCIS center is san francisco. May be it depends on BCIS center location .

You can always write to your representative and two Senators.
I encourage everyone to do that in order to put puressure on Don Neufeld.

Actually, the CSC seems to abandon the stupid policy about RFE due to the pressure of backlog reduction.
We should keep pushing the CSC and Don Neufeld.

This is interesting and the first I have heard of it, that CSC is dropping the RFE policy. Is this something you have observed in the scans or something you are hypothysing from the approvals you are seeing on the forum?

Dropping RFE's will drastically improve the approval process and if true might just improve the speed of 485 approvals.

Even though we have seen a couple of posts this weekend, they are very small samples.
Project Kashmir is not perfect, but it shows the trend more clearly.
The full report will provide more information, but we have to see more 4 contributions.
Until that, the part of approval list posted this weekend might be helpful.

Anyway, I believe the CSC had to drop such a stupid policy because of the pressure for backlog reduction.
And I have one more thing concluded from Project Kashmir.

well, in my belowed series 02-117 which is ahead of yours in line, we got 2 approvals out of 186 cases ,while 02-139 got 14 approvals so far out of 168 cases. This is definitely not FIFO :D
