i haven t responded to rfe yet as im still waiting for transcripts from irs..changed address and send ar11..how do i know if they had issued 2nd fp notice? the status check does not reflect the history on it..

now my problems:

1. company name change in 2001 from A to B without informing INS-same owners, same contract but different tax ID no. then company name returned to A again in 2002.
2. salary is about 40% lower than labor cert.
3. h1 expired in 12/14/01 lawyer filed I485 12/24/01 and RD is 12/30/01.

PLS i need advice!!!
 
For me, both my attorney and myself received the 2nd FP notices. So, check with your attorney also.
 
1. Sending AR11 does not update your address in the INS database. AR11 is state department regulations. For updating your address in the INS database you need to call the customer support number.
2. Technically for company name change you should have filed an amendment to your 140. Your lawyer should have done that, please check with him as to what can be done now.
3. Salary will be an issue, you should get an EVL that specifically mentions that you will receive LC salary upon approval.
4. You seem to be out of status for 10 days in 01, that is not good. Don't travel outside the country too much, other than that I don't think you should have problems on this account with your AOS.

If you get too frustrated while calling customer service, fax your adddess change in appropriate service center. For CSC, there is a fax form in CSC Guideline ( http://shusterman.com/pdf/csc2003.pdf ) for change of address. This change of address is specific to case numbers.
 
i recvd the requested tax returns from IRS and forwarded them to lawyer last week...lawyer hasnt responded to RFE yet..will keep u updated..
 
Out of Status Less < 180 okay!!

Out of Status Less < 180 okay!! per section 245(k). Question is how does that gets applied. Is that if BCIS raises the issue, then should it be mentioned? Any thoughts on this any body please. Thanks.
