All, gr8 news... our cases were approved yesterday (April 19th). Here's a quick timeline...

Labor filed: April 9th, 2001
Labor approved: July, 2001

I-140 filed: August, 2001
I-140 approved: November, 2001

I-485, 1st AP, 1st EAD filed: 12/14/2001

1st FP done on: 01/04/2002
1st AP approved: 02/22/2002
1st EAD approved: 04/02/2002

2nd FP done on (requested by lawyer): 05/02/2003
2nd, 3rd APs: early and late 2003

7th year H1 extension filed: May, 2003

2nd EAD approved: May, 2003

7th year H1 approved: Dec, 2003

3rd FP done on: 01/09/2004
3rd EAD approved: Feb, 2004

Mailed Dianne Feinstein: 02/16/2004 - complained about CSC's delay and provided my case details...

RFE generated: 03/13/2004

Response from DF's office saying that CSC has generated RFE: 03/19/2004

RFE received by lawyers: 03/23/2004 (tax transcripts from IRS, W-2s, paystubs, company finances, employment verification)

RFE replied: 04/02/2004
RFE response received by CSC: 04/06/2004

I-485s approved: 04/19/2004

During the November, 2003 - January, 2004 timeframe, I also participated in some of the campaigns initiated by Kashmir and others on this Forum but did not post my contributions here as they were sporadic... I am guilty of not participating in all the initiatives undertaken and can only offer a lame excuse of being preoccupied by work and other obligations.

All, I'm not sure how much my letter to Dianne Feinstein helped in the process... but I am grateful to her office for taking action.

In case any one is interested, here are the contents of my letter to her...

Subject: Delay in I-485 processing

Dear Senator Feinstein,

My wife and I applied for our I-485 (Adjustment of Status) at the California Service Center on December 14th, 2001. Two years and two months later, we are still waiting for approval. The unexplained inordinate delay in the processing has caused (and continues to cause) considerable upheaval in our lives and postponement of decisions ranging from home ownership to having babies to career moves. Throughout our stay in the United States, we have both been conscientious, law-abiding legal residents.

A brief timeline of our cases:
1. I-485, I-765, I-131 filed with CSC on December 14th, 2001
2. Finger-printing (1) done on January 4th, 2002
3. I-131 approved on February 27th, 2002 – second I-131 filed in early 2003, third I-131 filed in late 2003
4. I-765 approved on April 2nd, 2002 – second I-765 filed in early 2003, third I-765 filed in late 2003
5. Finger-printing (2) done on May 2nd, 2003
6. Finger-printing (3) done on January 9th, 2004

During this timeframe, I have neither changed employers or roles with my current employer that could potentially result in delaying our application processing. I-485 processing was continuing at a reasonable pace (taking roughly 10-15 months) until November, 2002. However since then, the I-485 processing dates at the CSC (based on the JIT report) have only advanced from November, 2001 to December, 2001 (1 month in the space of 15 months).

Our I-485 cases were applied for on December 14th, 2001 and the CSC is processing cases filed before December 16th, 2001. Considering that a Green Card was available for me and my dependents when my I-140 was approved, it is very disheartening to have waited an additional 26 months with still no light at the end of the tunnel. At the same time, more paperwork and consequent backlog is being generated as a result of our expiring finger-prints, EADs and Advance Paroles. Inquiries with agents at the National Service Center 800 # yield no information – they only repeat the information on the website and in the automated messages. My case still says that my 2nd FP results have been received while my wife’s says her 1st FP results have been received! The FBI has already confirmed that they received our 3rd fingerprints on January 9th, 2003 and sent back the results on the same day. However, there is NO way for us to figure out:
- if USCIS has received these results, or
- why my wife’s case status has not been updated since her 1st FP results, or
- where in the process our cases lie!

Please enquire with the CSC when we can expect our I-485 approval or if there is any reason for this processing delay or if they need any additional information from us. I authorize you to enquire with the CSC regarding our cases on our behalf.

Just in case you have not planned on it yet, I would suggest sending a letter to Dianne Feinstein informing that you got an approval and thanking her for her help. As you know not many people outside these forums respond to our requests. It bodes well for us to show our appreciation of their efforts.
