Got the approval of for myself and my wife. Here are the details:

WAC: 02-057-****
RD: Aug 21, 2001
ND: Dec 05, 2001 (Yes, after 3.5 months)
FP: Feb 03, 2002
FP Done: Feb 07, 2002
RFE Received: Oct End, 2002
RFE Response sent: Oct End, 2002 (Within a week of receiving the RFE. My lawyer has been very proactive)
RFE Received by INS: Nov 27, 2002
Approval: Feb 12, 2003
Country: India, EB2
Location: San Jose

I called IIO just once in June 2002.

Received RFE for employment verification letter. Sent only employment verification letter and no paystubs/W2's. I have been with the same employer throughout.

The online status still says that the RFE response has been received and processing has resumed on the case. However, the AVM says that this case has been approved.

I have been a frequent visitor to this group but am posting for the first time. Very informative group indeed.

Congratulation!
You are the first lucky man for Dec. Cases. CSC seems begin to deal with Dec.cases. But they just clean RFE cases. You give us more hope.

which counts - ND or RD?

i thought I was a dec 01 candidate - wac 02-077 RD is dec but ND is 01/03/02 (diff of 10 days). Will my case be considered a dec case or jan case?

His case is Dec, but it is very special, because his RD is Aug. :confused: RD date is Oct or Nov for Nov. case. Anyway, it is a good news for us.

I485andI824, good observation .. hey obelix .. is your RD really August? Then maybe INS goes by RD instead of ND. Hmm .. totally weird.
 
Yes, my RD is indeed Aug 21, 2001. During those months there was this scare of anthrax and the INS had stopped opening mails. I guess my 485 petition got lost during that time only to be discovered in Dec. Another thing to note -- My attorney had sent a fax enquiry for 485 receipt in late Nov, 2001. I am not sure if that helped.

I had called IIO just once in June 2002. I told the IIO that my receipt date was Aug 2001 and asked her by when I could expect the approval. According to her, none of my record on her screen showed any mention of Aug 2001. She said that my receipt/priority date was Dec 2001 and that I should relax because the approval was going to take quite some time. I took her advice and decided to relax and never called IIO again.

So, I guess you can treat me as a Dec case rather than a delayed Aug case.
