WAC-01 and Case Assigned

Hi, Guys:

My lawyer helped file the fax inquiry and the resonse was that the case has been assigned to an officer on October 13th.

Anybody can give an idea how long does it take from assigning to an officer to approval? Do you guys think that "assigning to an officer" is a better answer than "case pending adjudication"

One month has passed. Any suggestion on next action I should take?

The rule is that officer needs to make a decision in 30 days. Decision could be approve/reject/rfe/reassign to another officer.

I think calling an IIO and if he doesn't give you a reasonable answer, sending a fax ... would be okay at this point.

Do you know where this rule is stated ? I could send that to
my attorney and ask them to send a fax .. my attorney wants
to wait for couple of weeks more.
 
I don't know where it is stated, but I read this somewhere, and I was told this by an IIO on the phone (back in the days when IIOs actually cared).

After trying for 20 mins continuously I got connected and
then was on hold for over 45 mins...and finally chinese
voice picked....as soon as she picked I knew that all
the effort I had put is in vain(previous experience).
She said there is no status change and asked me to
check back in 1st week of Dec. If she responds to you
she is not going to give you any info other than the
standard AVM.

I don't wanna change my nick coz PCee is maintaining my stats by this name .. (I've already changed it twice coz of login issues).

I think IIO's have quit picking phones these days. I truly hate INS. I hope they burn in hell.
 
Thanks Atri123. Very informative staff.

However after checking the document I noticed one thing.

For fax inquiry it gives the instruction on how to make the inquiry. However after the first inquiry all the following up procedures are based on the fact that no response was received.

For mine case (and also several others) the case has been long passed the JIT time. The response to our first fax inquiry is "case assigned to an officer". Yet another one month has passed.

Any light in next action I should take?
 
According to Lawyer

one can go to higher levels of fax only if there is "no response". Even if there is useless response, it is considered a response and you can not go to the next level.

In case of RFEs we have to wait for 60 days after INS acknowledges receipt of the response. If no action then we can start the fax process at level 1. Its detailed in the same document.

garu1gsr you should be very close to that date if not already beyond that. In my case it 9/27 that they received my response so I have to wait for another two weeks.

But it looked like that if got response to the first inquiry (my case says "assigned to an officier", some others got the "pending adjudication" which gave even less clue) and we can only wait.
