What happens if W2's dont match...

My 2001 W2 shows annual earnings of 90K whereas in 2002 I had to take a huge pay cut because of bad economy and also switched employers after being laid off (using AC21 after 180 days with an approved I140) with a lower salalry, so my 2002 W2 shows only 54K annual earnings. However this year's earnings will be close to 75K.

Will this be a problem if I get an RFE asking me to submit my W2's

How does your current salary match up to LC salary?

If the above ratio favours current salary you have nothing to worry, if it falls below LC level, then remedial action might be best! Look up previous posts on this issue for further information!

W2

Thanks for ur response. I just got a raise and my current salary is 10K less than my LC salary. So I guess this years income should be fine. I am only concerned about the difference in my 2002 W2 which is preety steep.

cleanGC,

Again, your W2 does not have as much bearing on your case as a paystub which shows you are making as much as stated in your LC!

10K is a noticeable difference between LC and current salary. I would be more worried about that, as compared to being worried about the W2 discrepancy. Which can be explained by unpaid leave etc.

I strongly suggest you find a way to bridge the gap, either with addition of bonus or a letter from your company promising to pay LC salary upon GC approval!

Good luck!
