W2s with I-140?

Hi,

I have a quick question. My company plans to file i140 on my behalf. Do I have to provide W2s for the last 3 years (I had 2 employers during this time) when filing I-140?

My lawyer says it's not necessary at this point. I saw a couple RFEs in this thread because of W2s. I do not plan to file AOS as I decided to go for CP.

Any help is appreciated,

I140inCA, My personal experience and opinion is that, please provide the W2s for the past 3 years while filing your I-140. I too got an RFE for the W2s and I have seen lot of I-140 RFEs for W2s.

thanks for the reply! I was wondering if you could tell me whether you filed i140 and i1485 concurrently or 485 before your RFE on the I-140. It appears to me that BCIS does someting differently in the case of concurrent filings. When they evaluate the supporting documents for the I140 they seem to take a short look at the i485 documents too and make sure you have everything to support that and if something is missing they tend to send an RFE to the I140 since officialy they are not processing i485s! Just my speculation, i might be wrong.
There was another person under EB3 tracker CA who initially filed I140 and then later 485. After that he/she got an RFE for W2 on the I140.
