Is W2 hourly [no benefits] employment accaptable to INS as a valid permanent employment for green card purpose ?

Feedbacks/links will be very much appreciated.

Thanks

I think w2-hourly is fine. As long as you can get letter from employer that you are fulltime.

I thought some guys saying on this forum that few of their friends with w2 hourly were approved. (not sure)

I am not sure about no benifits. I think better thing is to buy benefits on your own. INS wont know if you buy or employer provided them. Paystub will only show that you are on w2 with benifits.

Dude .. As long as you are employed & working in the same field, doesn't matter whether hourly or pay is less than LC or no benefits or moved to other state or changed the address etc etc .. I have been there, done that and spent tons of time finding out ...

But murthy.com says salary vis-a-vis LC is NOWADAYS becoming an issue with INS.

Why I ask this qn is :-

A FBE salary of $100,000 will typically be translated to $80-90/hr.
Let us say the LC mentions $100,000/yr. The LC does not record info if the employment is fully benefited.

If one is laid off, for many it may not be easy to find a job which fetches $80-90/hr in the current market conditions. However, it will be relatively easy to find a job which fetches $55/hr, which will annualize to $100,000+.

pavan - when did you/others get green card under such circumstances ?
