My friend currently works for Company A in L1 Visa for past 2 years in US
Meanwhile, his H1 for Company B is approved and he plans to join Company B without telling Company A.
Since he has worked in Company A in year 2004, his tax will be filed by Company A
How will he get the W2 form for 2004 from Company A now. ( since it is necessary for his stamping)
Company A gives away the W2 forms to his employees only by month of July usually.
Is there a way to get the W2 form later from IRS directly.

Any help or suggestion or advice in this matter is reaally appreciated.

Thanks

The employer is bound to give / mail out the W-2's. So you can leave ur address with just before they usually mail the W-2's.

Also, the IRS can get you copy of the w-2. Do a search on this. A friend of mine did the same thing as u mention, he left his address with his previous copany payroll & they mailed him.

Thanks Subash.

Actually the problem here is... My friend is not going to tell Company A about leaving. He is just going to run away without telling. So he cannot ask Company A because, they might create problems for him asking to give notice,etc,...

Still can he get a copy of w-2 from IRS. Whom shud he check this with?

thanks for all ur help

they are legally required to send the w2 by january. there are no lawful reasons for an employer to hold w2. you have the option to complain to irs.

they cannot hold it just because your friend leaves w/o proper notice. those claims should be addressed in different way.

leaving the employer without proper notice is not the right way unless you have adverse lawful reasons. it affects their business and the clients. fyi employer can track you.

you can file tax returns even without w2. but you may need it for stamping in consulates abroad (you may also state the reason and show them all paystub as a proof of work instead of w2).

its better to come out of a company in good terms.
