I was reading the various discussions on this board and found a thread
where you mentioned that you personally talked to some one at INS HQ and
they mentioned that they will release AC21 regulations in 3 weeks time.
Is there any way you can call them again and check about the impending release
of the new regulations. I have been trying since today morning and I was transferred
to different places including the press office and I was not able to get any info.
I understand if it may be inconvenient for you to call again.

Also do you know of anyone else who had been able to call and get similar
info

Sorry, was out of town for last few days.
My calls to HQ have always been connected to different people.
However, on that one occassion I talked to a person who said that the
guidelines for AC21 are due out mid-May ( after refering to a list he had ). After that I haven\'t tried contacting HQ again. Maybe all of us should keep calling HQ and ask for \'Policy\' folks and keep \'nagging\' them until they issue the guidelines.
Can\'t think of anything else that might work.
And at the same time I think we should increase our calls to VSC and keep \'pressing\' them to release the hold and process these cases.

Thanks vsc_on_hold for your reply. I tried a few times yesterday and was mostly
transferred to the voice mails. The people I managed to talk were apparently not
the relevant people since they had no idea when AC21 regulations would come
out. The response I have always got from VSC is that they are waiting for INS HQ.
I guess the only way VSC will take action is if INS HQ will manadate them to remove
hold and start processing. Will try to call INS HQ again today. Never know which call might get an answer to resolve this hold. In case you have any more update pl post the same. I will also post any new info I learn on this issue

I had our director who is an ex INS emplyee to find out about the guidelines. He said Some staff member is working on it. He couldn\'t get any more info. Hope he will call some more people and see if we can find some clue.

I agree with cool_bandha that we should keep calling INS HQ. Thats the only place where the answer to our quiestions lies.

What do you guys think about the following plan:

H1. Lets everyone call HQ.
H2. Lets not talk specifics of our case (like EAC# etc. ) unless absolutely asked for. Give your contact number.
H3. Lets ask HQ to issue VSC written guidelines about the company (name) change clause AC21( instead of waiting for completion of guidelines for all of AC21 ) immediately.
H4. Lets atleast ask HQ to instruct VSC to release the hold and process the I1485s with an amended I140, per old rule until new guidelines come out. This if H3. cannot be done immediately.

Since, as it is clearly evident, VSC is the only center which took the decision to hold these cases while other centers are atleast processing these cases per old rules ( I140 redo ), I personally feel that we should also devote an equal amount of effort in pushing VSC to release these from hold and process them. Following is the set of actions proposed : (in case H1 - H4 might not yield the desired results).

V1. Call VSC.
V2. Keep bugging the IIOs to release the hold and process. ( Dont ask for status or when the new rules will come.) In the meantime they should process these cases per old rules atleast.
V3. Dont bother about rude replies. Keep to the point and tell them that you will call back next day to check until the holds have been removed. Tell them that it was not our fault that VSC delayed processing these cases. What if tomorrow there some other new law ? Will they then put these cases on hold for a new reason ? Put the pressure on them.
V5. IIOs will definitely say that every case is different. Hence some were approved while others were delayed and therefore on hold now. Dont take that for an answer. Ask them specifically, what is different about your case ? What did they find ? Did they send an RFE for additional info. ? If they dont know ask them to transfer you to a Supervisor. If they cannot tell you what the difference is or that no RFE was ever sent out, then tell them to process it immediately because it should have been processed long back.
V4. Call back next day and repeat above steps.

Hopefully someone higher up either at HQ or VSC will be pushed or frustrated to issue the guidelines very soon.

I just noticed (from an immigration chat group) that when the AILA had a conference
with INS, the person who verbally committed to the 180 change of job rule is:
Tracy Renaud, with INS HQ.
Although I don\'t have a number, at least we have a name to look for when calling
for guidelines !

vsc_on_hold I fully agree with your suggestions. Lets all follow h1-h4 and v1-v4
By the way the ins web site www.ins.gov also allows you to make comments/suggestions
by clicking on the comments section. I encourage everyone affected by this issue
to also put in their comments at the ins web site requesting ins to release ac21
regulations soon.
