Hi,
My EB1-OR , ND in may is still pending, I wanted to know how safe and ok its to file now for I-485 according to this new rule? and whats the probability to assume that the I-140 petition will be approved smoothly and soon? I read on some site that filing for I-485 without approval of I-140 is risky? is that correct? Pl post your views.

Mere speculation,, Not many I 140 gets denied.

I think if you want to take the benefit of the new law,, you can and apply for your EAD/AP or you can do nothing and go conventional and wait 6 months to get your I40 approved and then apply. Choice is yours but I presume that when INS gets all these apps,,,, your 485 will be delayed since your RD for 485 will be on a later date....
