Looks like I-140 in EB1 category, atleast in Vermont, has been specially chosen for step-motherly treatment. The last approval I heard of in this category had a RD of mid-Feb, 2002. Could ladies/gentlemen who applied in this category (in 2002) and got approval post their details. It will help likes like us to assess our predicament. My Eb1 (OR) has a RD of 28 Feb. 2002, and no news yet.

I called them in the first week of April and the response was that they are going to pull it out and start working on it. Nothing since then. I must add that I received my EAD and AP in the meantime. At this rate looks like I will get my GC without I-140 ! No RFE yet. What's ur story like?

What do they tell you when you call them?

Did they ever send you a RFE?

same boat

I am also in the same boat. my ND is may2002 and EAD and AP approved in feb, FP done in march.no news about EB1-OR, I have never called though. does it helps?

pl keep posted about any news on EB1
thanks

My ND is April 24, 2002, two moths after you.
I got my EAD in September 2002.
Called them several times. Spend on phone hours. Waste of time (and money).

Could anyone tell me how flexible is this category (EB1 OR). If I quit my present job at which this petition was filed, and take up a new job on a new H1B or the interim EAD, will it have an adverse affect on the pending I-140? Thanks in advance.

I think that OR is very much unflexible.
At least this was true 2-3 years ago, as my friend told me.
You have to work till the very end for the same company (University) that sponsored you. It is easy with a University, you may switch Labs or departments. But not so easy with a company.
I do not know exactly how AC21 portability rule works for OR. That is why, I think, some people file both OR and NIW petitions.

NIW and EA do not require company sponsorship.

As for me, I filed EA petition only.
