VSC 485 denied

Hi All,
My Appl. was denied by the ins (VSC). 3 months ago I was asked to file an I-140 for a Co. name change. My #@$% lawyer refused to do so, even when I asked him to file atleast an amended I-140.
I was hoping the ins will come back and ask me to file an amended I-140. But instead they sent out a denial notice (Can\'t be appealed!) based on the unfiled I-140.
I heard that I can file a motion to reopen. Is this feasible? If so,how long does it take?
Can I stay in the country under my EAD which expires on 02/2001? Any input will be appreciated.

My Friend,

Don\'t get panic.

1.First talk to your attorney who handled your case.

2.If he is a competitive attorney, he then should fight against INS taking all proof.

3.If your attorney is not cooperating then talk to your company and try to handle this with another attorney.

4. If statement 3 is true then talk to a lawyer to file lawsuit against the first attorney for causing trouble in your life.

I once asked IIO about not doing I-140 redo in the case of name change. They clearly told me, there is a chance to get a denial letter in case you don\'t send requested material to INS. The same thing I asked my attorney and he replied not to fight with INS in the best interest of case.

Does anybody else have knowledge of simliar cases?
Has anybody fought an I-485 denied case against the INS?
Thanks in advance!

Motion to re-consider requires a change in material status which perhaps caused the denial in your case.

So if you apply for a new I140, I beleive, you may be able to apply for a motion-to-reconsider. "How long" is impossible to predict when we are talking about INS.
