Vistor Visa Question

Hi All

I got married in June. My current H-1 B is expiring on Sept 20th 2003. I am planning to bring my wife to the US. As she is still studying in India I did not bother to go for her H-4 Visa as she would have got it till Sept 30th only. She has one month vacation in the Novemeber. The current processing times for H-1B extension is 2 1/2 month delayed, so I will most probably get it in December. So I plan to get her on a vistors visa(B-2)

1. What are her chances? ( I am sending a copy of my new H-1B extension receipt from BCIS and all the other necessary documents).

2. I do not have her name in the "Name of the spouse" column in my passport and neither does she. Will this be an issue? Is a marraige certificate not sufficient?

She will most likely be refused a visitor visa because you (her spouse) is in the US and she cannot prove beyond any doubt that she will return to her India after visiting. Remember visitors visa is just that, only for visiting.
 
But she has one more semester left and she will get a letter from her college director to that effect and will also get a no objection certificate from her director.

Can somebody please respond. My wife's interview is next week and I want to make a decision as to she should go for the interview or not.
