I am working since past year and half with a Canadian company (work permit) and want to know my chances for getting a US visit visa .... any advice will be appreciated.

I have applied for a US visa twice and refused based on the ground that the visa officer was not convinced about my intent to return - the form letter says 214(b). I was in the US for a year or so, on B-1 in 2001 and then applied for extensions, and got them and then got a job offer and came out to get the H1 stamped and they canceled my B1 and I did not get the H1 too.

My case is as follows:

Am married, have school and college going kids, family and property in India. They are in India and I am in Canada, since Jun 2006 on work permit, employed with a Canadian company in a senior role, and I shall soon need to visit the US for business.

When my company had applied for my US visa (after returning back in 2003) I was working in India in a senior position with US multinational ($ 500mn company, listed on NASDAQ). This company applied for a visit visa in 2005 and then again in 2006 and was refused both the times. The fact that I could not get a US visa affected my growth prospects and I left the company in 2006 to join this Canadian company.

1.
- I entered the US in 2001 and my I-94 was valid upto June 25.
- I applied in time before the expiration for an extension to stay upto Dec 25
- The approval was received late in Jan 11, 2002

2.
- Promptly applied for another extension on Jan 25, 2002
- Got a denial on Jun 27, 2002
- appealed June 25, 2001 on the grounds of the delayed receipt of earlier approval
- Appeal was accepted and got the approval

3.
- In the meanwhile i got a job offer applied for H-1 on jun 27, 2002
- H-1 issued july 19, 2002 valid from June 18, 2002 to Dec 2004
- I exited from the US in Aug 2002 to have my H-1 stamped in Ottawa (Canada) and here they canceled my B-1 and asked me to approach the US Consulate in India. In India they asked me for additional documents from the employer which never arrived. So I found a job with a US multinational and stayed back.

The point is that I went out to get the H1 stamped legally, against all "advice from well wishers" and walked into all this trouble.

I have been in an out of the US three times since 1980. The first time, I visited was much before I married or had any property or "ties to bind me" - I did not stay and even now I do not want to stay, but there is professional business I need to attend to from time to time and this makes it necessary for me to visit the US.
