Visitor Visa question- Is there a change in rules?

My in-laws visitor visa has been rejected twice. I read on the bombay consulate website the following : The link is

If you have been refused a US visa, you can re-apply for a visa after three working days from date of refusal - only through the Interview process.

Note: Applicants can turn in their applications at a VFS center irrespective of the number of times they have been refused a US visa.

Is this true? I know an earlier rule that you could reapply only after 2 years..
Is there a change in laws?

Yes. They can apply after 3 business days. My parents applied 5 times and they got rejected all 5 times.

There is no method or sanity to the whole visitor visa approval process.
After trying to apply a lot of logical meanings to the approval process, I came to the conclusion that it is based purely on luck (assuming of course, that all documents that we provide are OK)
My in-laws were rejected twice. They asked the second time, what is the reason. The officer said, she didn't think that they would return back.
What the hell... What would a 75 year old man and 70 year old lady do in this country for more than 3 months?????

Just send your parents for the interview and hope for the best.

Hello All, it would be very helpfull if you can reply back to me.

My parents visitor visa got rejected because my father's sister had filed an immigrant petition on their behalf(green card). If the petition is not availved within 1 years then it automatically gets cancelled. We did get letter from American Embassy that the petition has been cancelled becuase we did not avail the petition.

Now my questions is: Can we apply again as now their is no intention to immigrate to USA? We are bit hesitant!!

Is that letter enough to justify the cancellation?

When i called National Visa Center they told me that the send the case to Delhi American Embassy and they don't know any further details?

Visa got rejected

Hi,
I found out today that my parents' tourist visa got rejected at chennai. Under 214(b). Please tell me when and how they can re-apply. There is no point in applying in 3 days bcos it will get rejected again. We are thinking of applying in a few months' time again. Can U tell me how we shd apply - in person, letter?? the information out there is very confusing.
I dont know how to prove intent to return. this is crazy.

My mother's visa got rejected 2 times in January this year and I thought waiting for another 4-6 month might changes the scenario a little bit... But seems like they are just sitting to eat up all our hard earned money for no reason...

Wouldn't want to upset you but even if you wait for 4-6 months there is no guarantee, that they would get the visa then.

CAN SOMEBODY HELP US OUT HERE!

Appreciate if people don't start writing about preparing documents, since all of us knows what documents to prepare and prepared them correctly to our best knowledge.
 
Sam, a couple of people have mentioned that they got a letter from some congressman and sent it to the consulate. I'm hoping to try after another 8-10 mths. If anybody has any information on the congressman angle, please help.

tufan: The reason that they said that "They don't think my Mother would come back India"... Come on guys a 62 year old relegious lady can not even live in USA for a month (my mother is not even ready to come, its us who are forcing her to visit atleast once until we leave USA for good).

jrao124: These days Consulate is also rejecting the Congressman's letters as well. Thats what I came to know after researching on this angle.

DON'T KNOW WHAT TO DO...

If this kind of treatment our parents are going to get from US Embassey, we would be forced to leave the country some time soon to go back to our Mother.

I am sure I am not the only one who thinks this way, there are lot of people who thinks the same way. Pretty hopeless situations but CAN ANYBODY HELP?

I don't know much about your case. My jijaji had similar situation, however in his case his father had passed away long long time back. His sister is also living in USA, therefore they rejected his mother's visa 3 times as they knew she won't come back as he is the only son and therefore she is potential immigrant. (Luckly, my jijaji's sister had already become a citizen and they had to wait like 1 year and their mom is finally in usa with green card).
 
Is this visitor visa rejection specific to US consulate in madras or is it common to all US consulates ? I heard they're also rejecting L1 visas if the applicant does not have a degree in Computer Science or related fields.

Its pretty much the same case.. My father passed away in Dec 2000, and I only have my sister with her entire family in India and she is the one who take cares of my mother at the moment in India.

We had issues at Delhi Embassey and they were pretty rude too at the dealing with my Mother second time, since she asked the reason for refusal and about what documents would satisfy there approval criteria.
 
what can be done???

The 'Potential Immigrant' rule is mis-used by immigration officers. Why can't they deport people if they file for GC after entering on visitor visa. It is like give opportunity for people to mis-use and at the same time trouble law abiding international visitors.

As per law H1/L1 visas are dual intent, but they reject some of those cases saying potential immigrants...come on US immigration you can't have it both ways. 'Plug your loop hole' and stream line the process. US immigration needs a thorough revamp from ground up.

Example: 'ability to pay', 'potential immigrant', unnecessary RFEs, and then make mistakes in entering citizenship on I-94 cards. I am a victim of first and last items.

I hope Ombudsman Khatri's report when implemented atleast partially addresses these inefficieny issues.
