Visitor Visa for Parents Denied

Sorry for posting the question on this thread.

My parents were planning to visit me in December for some time. They went for getting the Visitor visa with the sponsoring docuements I sent. They were asked a few basic questions and then the officer just said "Sorry". The officer din't even ask for any documents. Looked like he just wanted to deny giving the visa.

My question is how soon can they re-apply. What is the maximum number of times they can re-apply, before the 2 year cap. Has anyone else faced this problem, if so then what did they do.

Your help is appreciated. Thanks in advance.

PS - I am still waiting for my AOS approval. WAC 02-03x

My sister was denied visa too

She was coming here along with her daughter and was denied a visa.
I think you can reapply within 3 business days and she was told by the councillor that if you are denied one more time you cannot reapply for 2 years.
But I am not entirely sure.

Some more details please

nam29 and MagicGC,

Can you please post more details such as the ages of the applicants whose visitor visa applications were denied? Is this the first time they were denied the visa? Were they in the US before?

This info is important for me as I am planning to bring my parents here for their second visit in Feb next.

Thanks

Strange!!??!!

MagicGC,
Is this their first visit?
What was the basic qn asked and what did they answer?
What documents did you send for their visa?
Which consulate did they go? (if you can tell that)

The other person said that his/her sister's visa was denied, which is usual. Consulates will mostly deny any relatives other than parents. I have heard many cases of such denials but this is the first time I am hearing "parent's" visa denial.

I have given papers for my parents, in-laws and also helped many of friends and nobody had this experience. I have heard that the consulate asked for more documents from parents.

There should be some reason behind this and could be solved.

This is so not right. Yea I know the dude just wanted to refuse the visa. Anyway, you can apply again, the third time around it has to be drop box. And thats the final time they will consider. But I have known cases where the visa was rejected the third time, and people approach lawyers and presidents and senators here and get it moving eventually.

Parents got visa in Mumbai

After 4 visits to the drop box office, my parents were told to appear for an interview and were finally given visas on Dec 3rd. No questions asked other than how long had it been since they had seen me.
They asked for my original birth certificate which I didn't have, hence the trips to the box office.

Heard that the Madras consulate has a major hit rate as far as rejections go. Bombay and Delhi are a lot better.

There is nothing you can do in cases like MagicGC's parents, in which case, you go back on a different day of the week and hope that ass who denied the visa is not the visa officer again.

But generally since the parents are usually senior citizens and can show property/money/ties to the home land, as well as the sponser show enough money to support the visa shouldn't be a problem.

I seriously doubt the approach of applying for a visa in order to see the children. I think it is better to just apply and say you are a tourist. No need for sponsor ship letter and higher chances of approval since tourists are welcome and they are more certain to go back (atleast in theory).

Further information

My parents are in mid 50's and they visited Bombay Consulate. They were applying for a US visa for the first time. The questions asked are:

1. Have you ever visited any other countries in past
Answer: Yes European countries (as my dad had visited few European countries on business - job related)

2. What is your business
Answer: I own a shop

I guess the officer may have to go for Shit or some thing and so he said "Sorry" (denied the visa).

Atri - Thanks for the links

rleyrl - 4 visits to the drop box office, does that mean they had to apply 4 times for visa.

What the heck was in that officer mind to stop the Parents . Wish Indian cosulate do the same to that officer's folks when they want to visit . Denying the visa to parents to meet there kids and grandkids , i think this should come in minds of Human rights activicts . Keep on applying till they give you visa.

4 times for different reasons

They had to go 4 times because:

1. First time they did not take my birth cert.
2. Second because the bc that they took was not the original.
3. third time because I forgot to send my I-485 receipt.
4. Fourth time because the guy at the drop box did not know what the AP documement was for.

Luckily the guys at the Andheri drop box were nice enough to keep telling me folks what the missing docs were and gave them the opportunity to come again.
My folks said that a couple in front of them were rejected with no reason given, and that the guy who interviewed them was really nice.

MagicGC,

Dont worry. It happened to my parents too. But, I did not give up. I went to the local senator's office and made an issue about it. I could not meet the senator, but left a grievance letter with his office. In my letter, I gave complete details of the denial etc., and within 3 days, the visa was issued. So, give it a shot.

Good Luck.

Panther.

Thanks guys

Thanks guys for your response. I am a bit releived.

Shall ask them to go once more for stamping.

Exactly, and considering the attention this thread has gotten, we can all be sure that we are good boys and girls of our dear parents.

Some one in the office told me that Bombay consulate denied B-2 visa for his parents (father retired little over 58 years old) last week.

So far no such news from Delhi consulate. Seems like someone is not having good time in Bombay consulate. This stupid consulate officer is screwing up ....

I have heard that US Ambassodor to India is a good person. Affected people should right a nice and polite letter to him.

I heard of one person (a lady!!!) in the consulate who usually rejects visa applications left & right. May be that officer has been transferred to Bombay now as that is usual for the adjudicating officers be posted to all the consulates in the country.(round robin)

MagicGC, ask your parents to try once again giving atleast a week gap and go in another weekday to try to avoid that good hearted!?! officer (as someone mentioned above).

Good luck!!

Don't know if it is the same woman, but have heard the rejection stories about some woman too. Also I remember that the visa officers of Indian decent seemed more likely to reject visa's than the others. :(

Horrible to hear the Bombay consulate is rejecting visa's. In the good old days, hadn't heard of a single rejection. That too for parents (55 +), visiting their children. Guess we can pretty much thank Osama in part for that.

Blackwell the American Ambasador to India has an Indian wife. :) Don't know how much it would help to write to him, but it will definitely help to ping your Senator.

I would suggest you to go through following link. It would have answer to your questions. I used this site to prepare documents for my paranet. She got visa with no questions asked at bombay consulate.

Click on Visitor Visa
Click on Refusal and Reapplication.

Thanks for providing the link. Actually I already read most of the information on the web site. I really hope they get the visa the next time they apply.
