Hi everyone:
I'm writing with a question about extending a B1/B2 visa stay for a relative, who wants to extend her stay beyond Oct. 31 (her current I-94 expiry date) to the end of November. If she applies for an extension at the Vermont Center now (I-539), it's rather unlikely that she will get the approval before she leaves in November. Having applied for the extension, her stay until she leaves will be legal; however, what happens at the airport when she leaves? My understanding is that one submits the original I-94 with the I-539. Will not having an original I-94 at the airport be a problem? Will this have any impact on future trips?
The other option she's exploring is going to Canada (before Oct. 31) to visit relatives. If she surrenders her I-94 on departure, she should get a new one on return, and I would guess that there shouldn't be a problem getting permission to stay till her departure date in November (she'll have confirmed return tickets to India). Will surrending the I-94 at the airport while going to Canada be a problem?
Your thoughts would be most welcome!
(Applying for the extension shouldn't be a problem: her reason for being here are quite genuine. Her husband passed away in the summer rather suddenly, and she's staying on with their daugther for a bit longer)
