Visitor Visa - Deporting case

I need your advice in a deporting case.
A friend of mine who has got 10 years visitor visa stamped came on visitor visa to USA in April this year . He was accused unnecessarily and deported for 5yrs and was sent back to INDIA immediately from the port of entry. He visited USA few times before. He was manhandled by the immigration officers and they unnecessarily accused as a fradulent person. He is 50 year old person and an innocent man who came to USA to visit his son who is working here.

Now you know the case . Is there any way where we can prove his innocence aND remove bad accusition and mark on him and get him here with removal of his deported period for 5 yrs.

Please advise .

There must be some reason for deporting him. You have not told the complete story. One of the following could be the reason:

1) He overstayed for more than 6 months in the past;
2) His name matches that of some criminal/terrorist;
3) He had fraudulent or altered passport;
4) He provided incorrect and inconsistent information;
5) He expressed intent to immigrate to US.

Here are answers to your questions:


There must be some reason for deporting him. You have not told the complete story. One of the following could be the reason:

No he never did that.
He cane to uSA 3 times and always manitained good records regarding his stay in USA.

2) His name matches that of some criminal/terrorist;
NO. The immigration officers did not indicate any such thing.

3) He had fraudulent or altered passport;
No

4) He provided incorrect and inconsistent information;
He provided all the information required by the officers . He provided all his previous
I-94s to show them that he never overstayed.
Also they even accused him of bringing lord sai baba's pictures. He carried with him his date of birth
certificate, retirement orders and income tax statements from India. He laso had citibank credit card and
a credit card account from the bank in USA where he opened an account previously in order to use and save
money given by his son who is working in USA. Seeing all these they accused hime saying that he is doing Illegal business or illgeal job with out proper
staus in USA .It seemed like they wanted to send him back to India some how by accusing him as a fraud person. They said they will
imprison him for 1 yr if he accepts that he is fraud and then allow him to meet his son or he should leave immediately
to India.
They even manhandled him and forced him to accept that he is fraud.
Poor old person did not want to take false accusition on him and returned immediately.
The immigration officers did give water , food to hime for 6hrs and interrogated him.
He did not even call his son for more enquiry.



5) He expressed intent to immigrate to US.
No . he expressed that he just came on visit to see his son based on his visitor visa.

Please advise if there is any way to remove the wrong accusition on the poor old person and
get him to usa once again.
 
That is a weird scary incident.. Which port of entry did he enter from? The only choice your friend might have is to contact local congressmen/senators. They might be able to get the issues straightened out.
