Hello,
My parents visited usfor the first time in 2001 (with a 6-month visitor visa). We extended their stay by 6 more months since we were expecting a baby. My parents returned to India in Feb 2002, 45 days after our baby was born (2 months before their extension expired). They had received their extension of stay notices and the new I-94s before they went back to India.
Last week, they applied for a visitor visa at the Chennai consulate, but unfortunately, my mom's approval of extension of stay could not be located (my dad had his document). The officer concluded that my mom had overstayed during her last visit and denied their visa.
1. Has anyone faced a similar situation?
2. What are my options?
3. How do I get a copy of my mom's approval notice within 1 or 2 months(I had called INS in US and they asked me to file I-824, which is currently taking 16 months to process)?
Please advise.
