My dad was in the US from 1966-83 on a green card. he went back to india in 83 and has only visited the US once in 1985 since then. After that he surrendered his GC. In 98 he applied for a visitor visa for a family emergency but was denied because the embassy had somehow mixed his report with someone else of the same name who was apparently on their black list. They sent his file to the US for a further investigation and eventually he received a letter from the chief of the non immigrant visa division at the mumbai embassy stating that they had corrected the information and that he was free to reapply. My father did not reapply as there wasn't any need for him to travel at that point.
Last week my parents applied for a visitor visa to visit me and were denied because of the same reason - the embassy claims that they still don't have the updated information on their system. even when my father showed them the letter that he had received from the embassy, they flatly refused to consider it. They did not even tell them whether the file would be sent to the US to get matters cleared, and refused to answer any of his questions.
Does this have to be resolved by the embassy or can someone in the INS or Dept of State take up this issue with the embassy. If so, dooes anyone know whom I should contact and the procedure for the same? Don't know if it makes a difference, but i'm a US citizen.
