Visitor visa and Green Card application

Hi guys,
I have green card and I married a girl outside of the country. My question is that if she comes to US with a short period visitor visa and I file green card application for her during her visit, can she stay legally in US afterwards?
Any information is greatly appreciated. Thanks!

David

Unfortunately, you just will be able to file for the I-130 Petition for an Alien Relative. She must mantain her own legal status (which won't be able to do it in a tourist visa B1/B2) until her priority date is current and there is a visa number available for her, so then she will be able to apply for Adjustment of Status if she is in the US or go through Consular Processing if she is outside the US. The waiting is in years.

You can check at www.uscis.gov for more information.

Good luck,

I have almost the same question, but really different in some way. I have a green card for the first time since almost 10 years in the US. I obtained my green card via asylum adjustment. I will like to travel to my home country which is partly save by now, are customer and immigration officers going to treat my case as perminent resident or asylum?
