visitor visa and family based immigration pettition

have any one seen this situation?
I am applying for a US visitor visa for a family member. Some one has filed a family based immigration pettition for this family member some years ago and it is in process.

I see that there is a conflict of statement when you apply for the visitor visa. ie, in visitor visa application one will try to prove that they will go back.

any suggestions?
