I'm planning to visit India for 3 weeks in February 2011 second week. Currently I'm working for a company as a contractor and I'm on OPT Extension status. My OPT is getting expired on June 28th 2011. I'm planning to apply H1B visa(premium Processing) after I come back from India probably by the First week of March 2011.
My Concern is all about the risk while coming back to US at Port Of Entry.. Because, by the time i return from India my OPT Extension will expire with in 3 months (Expiring on June 28th 2011).
If any Immigration Officer at Port of Entry points out then how could I defend myself. I even heard that traveling with in 6 months of expiatory of Visa will have potential risk. My visa is expiring on September 7th 2011.Do I will face any risk in this situation at Port Of Entry.Please let me know your suggestions in this regard so that I can decide accordingly.Looking forward to your valuable replies.
