Hi There,
I graduated Dec last year and I have been on OPT status working for a company since then. My company helped me filed the H1-B and it got approved since May, however, the approval notice indicates it will not take effective until October 1st this year.
The problem is:
I am planning on a business trip abroad to Hongkong (I come from China) the end of Auguest, and only stay there for a few days and need to come back to the U.S. However, my visa has expired long time ago and now I need to get my new VISA to reenter U.S.
In my point of view, there is no way to apply for H1B even if I got approved because of the timing issue. Then I only have to apply for F1 student VISA(OPT is still F1 right?). Then I have to go the embassy and prove the people there I will come back to China and would not stay in the US after OPT ends, which absolutely against the reality.
I am wondering can any one help me would this business trip be possible and what should I do so in a short time of period to get stuff done.
Appreciate your advice.
