Visa stamping with EAD

Hey,
This is for my friend.
He\'s a student, with EAd working for company A.His student visa stamped in passport is expiring on May 31, 2002.His EAD card expires on September 2002. He\'s a permanent emplyee of company A and they agreed to sponsor H1.

The question is he wants to go to India on June 2002.Since his visa in passport alreadt expired can he come back to US showing his EAD card validity?

or can he use his EAD for visa extension for 3 months? what\'s the probablity of rejection in his case coz he just has 3 more months in his EAD card at that time.?

Well your message confuses, but some answers

1) You said he was student and he is working on EAD . How can he get EAD, Is he dependent of somebody.

2) EAD is only to work not for entering into the country. He needs to have a valid VISA or PAROLE.

If you can explain clearly all the facts , somebody might answer , but you message is kind of confusing
 
Leaving US on an EAD

As far as I know, people earlier (prior to Sept 11) left the country on an EAD (OPT) and came back without any problems. But apparently nowadays it is creating a problem. (one of my friends was stopped and questioned a lot and got back with a lot of difficulty)
Legally, an EAD obtained after BS,MS etc is not valid for reentry (it states so on the EAD) even if your F-1 visa is still valid, so it is advisable not to leave the country on an EAD (you might risk it and get away with it but these days I\'m not sure if that might be worth it!)
Also, if you have to then apparently it is a good idea to take a letter from your employer regarding your status here.

But if the EAD (OPT\'s) validity is still September can he get a visa with his OPT-EAD?
He can also get a letter from his employer regarding his status!

So i think the only choice is to apply for a H1 now and then stamp it in india.
