I work for a Corporate Employer. My sixth year in H1B ends in 3/12/10. My employer has filed for PERM process in 3/12/09. Labor is still in progress, my HR says it should be approved by Feb. We never know what happens in PERM process.
I need your advice what to do in this scenario.
1) Wait till Feb - If Labor is not approved, then go to India. Try for Visa stamping and Stay for a month to extend my
sixth year to 4/12/10.
2) Go to India now itself, try for Visa stamping and stay for a month.
Will there be any issues in Visa Stamping, since there are just 3 or 4 months for my visa to expire?
I am totally confused what to do. Any suggestions will be very helpful. Thanks for your time!
