Can you please answer my below query.

Following are my details:
1.Visa of Ex-employer in my passport has expired on May 17, 2007
2.Changed employer and joined current employer in Jan 2006.
3. Current I-797 valid till Dec 15, 2008. No visa stamp of current employer in passport.
4. I am planning to schedule an apppointment for current employer's Visa stamping in Mumbai, India in June or July 2008.
5. Time between old visa expiry date(May 17, 2007) and visa appointment date(June or July 2008) will be more than 13 months, so I do not qualify for visa renewal category.
Now my question is : Is it OK to go for H1b stamping (While my I-140 filed in Feb. 2008 is still pending and only 5 months validity of my current I-797 will remain when I go for stamping ) in June/July 2008?
