visa stamping close to expiry

hi,

Please post your suggestions on this. Thanks a million!!

The current H1 stamp in my passport has expired, but I have a valid approval notice (I-797) for my 7th year extension. This petition is expiring by July-end, 2006. I am planning a trip to India during April 2006.

If I go to the Chennai consulate in April to get the visa stamped, can they reject me or cause problems because my petition is expiring in July (just three months from April)?

Anyone, or those of you who had similar experiences,your valuable feedback will be greatly appreciated.

have you already applied for new I797 after july'06?
usually, the visa request can not be rejected just for this purpose.
but this is just my opinion. you may talk to a lawyer in this regard.

No, I haven't yet applied for the new I-797 after July'06. That brings me to yet another question, can I possibly apply for an H1 extension now even though the current I-797 is expiring more than six months away in July '06?

No you cannot. My attorney said it has to be within 6 months time frame.
You might want to double check this information.

I am wondering if there is anyway I can confirm whether The Chennai consulate won't cause problems because My petition expiry date is just around 3 months from the date of my visa stamping appointment. If anyone has heard anything in this regard, please post your valuable feedback.

As far as I know they cannot reject the visa saying it has just 3 months remaining. Only thing is your stamping on passport will expire in 3 months, but I guess you do not care about that once you enter in US.
You can check with some attorney before leaving.
 
one other suggestion would be for you to try canada for visa stamping and go india and come back.
it is true that one can apply for i797 atmost 6 months from the expiry date of the prior i797.
have you secured appointment at chennai? did you do regular or emergency appointment? would appreciate your posting reply to this one.

Yes, I got the april appointment at Chennai. Right now, the available dates start from April. I did regular, of course.

since the visa stamp in my passport has expired, worst case if they deny stamping in Canada, I will have to go directly to India from there. Too much of a risk, especially when you have your family with you. Hence I didn't pursue the Canada option.
