Hello,

My Visa Stamping expired in April 2004. But I have a renewed I-797 and I-94 with it till Dec 2004. I am not planning to go outside this country for another year or so. i would like to know, if i just keep getting my I-797 renewed again(after dec 2004), is it enough?

Say If i go to india in dec of 2005 and produce my latest I-797, will my visa be stamped('cause it would be expired for more than a year by then). Is there any technical difficulty with it, with the new rules that stopped revalidation at St.Louis???

Thanks a lot,

Tani

Yes, a visa stamp is not required if you do not plan to travel.

Yes. The visa stamp is based on the underlying H1 petition approval. As long as you have the approved and valid H1 petition you can get the visa in India. The 1 year expiration rule applied only to revalidation in the US.
