Visa revalidation or wait for EAD/APs

My H1 and my wife's H4 was getting expired on April 14, 2004 and my company had filed for H1 extension on January 13, 2004. I got my H1 and my Wife's H4 Approval notices a week ago.

Should I send our passports for Visa revalidation?

I got my Labor (Green Card) approved.The EADs & APs for me and my wife are applied on May26th, 2004. I guess we should get them with in three months. Is there a need to get the visa revalidated in the passports even after we get EAD/APs.

Our new I-94s (attached with the new I-797s) are till May 10, 2006 but the question is should I get the visa revalidated or wait for Advance Parole approvals?

If I need to get visa revalidated, Can I send them to St. Louis or is it necessary that I go to India and get it done?

How long can a person stay in U.S after the previous I-94 expired but got the visa renewed?

Any replies are appreiciated.

Ans: You can send it to St.Louis, but its not really necessary as you would be getting your Advance Parole's shortly. There is no use to get it stamped, as you would however be paying more money on your AP's every year, so its better to use it once than keeping it idle.

But the choice is yours,if you want to renew.. But I have given you my opinion.

Ans: You should get it in next 2-3 months maximum.

Ans: You can attach those I-94's to your passport, so when you leave the country you can hand it over to port of exit in USA. Wait for AP's.

Ans: You can get it done in India, provided you have a long vacation of atleast 2 months, as I hear from my friends that it takes 2 months to get an appointment. otherwise, you can schedule an appointment 1 month before you leave to India, so that it will be all set to get the visa during your short stay(1 month).

How long can a person stay in U.S after the previous I-94 expired but got the visa renewed?

Ans: A person can stay in USA even with an expired visa as long as the I-94 date is valid and long.. In your case its May 2006.

Visa is needed only to enter and not to stay in US.

I have a friend who wants to get H1 stamping in India, in Chennai. (It is a case of status change from H4 to H1).

I would appreciate if someone would let me know how to make an appointment in the Chennai office.

if i want to do my visa revalidation in india(iam going to india within 2 months)
i recently got my visa extension till nov,2005. For stamping in india, do i need to go to chennai or can i get stamped at port of entry

Hi Sree234,
You dont have any option like getting it stamped at the Port of Entry.. If you are a Canadian Citizen then if you get a job in US, then you can get your H1B stamped at the port of entry, but I dont think that you fall under that category anyway.

Your best bet is "Madras Consulate" only. Schedule an appointment now itself to avoid delaying your travel arrangements back to US.
