I am working on my H1B visa. My passport still has my previous employer's stamping and it is valid until Dec '03. The current employer's I-797 is valid until Dec '04. But I got laid off from my previous company and they cancelled my visa. I am planning a trip to India this Dec or Jan'04. I just want to make sure I can re-enter the US without any problems. I know I should have the current employer's stamping when I re-enter the US. I am afraid I would not have enough time to do the stamping while I am in India. so I thought I could send the passport to St.Louis now.
My questions are:
1) I know I can send the passport to St.Louis for stamping only 3 months before the visa expiration date. Can I go ahead and send my passport ?. Will there be any problem as my previous H1 was cancelled ?.
2)My GC is in process. My labor got cleared, now I am going to apply I-140,I-484,EAD and advance parole together. If I get my EAD and advance parole approved, can I just forget about visa revalidation ?
Any inputs will be highly appreciated.
