Can anyone advice me on my concern ?
I am completing 4 yrs in US on H1B. Now i plan to go to India on vacation in June 2010 with wife and 2 kids. and i have to go for visa stamping in Hyderabad.
In 2002, once my H1b was rejected under 221(g) at chennai. In 2005 I got the visa in Kolkata. I came to US in 2006. Now i am with a 3rd employer (first 2 are consulting companies, now i am a full time employee in a big concern). when i was transferring my H1 from 2nd to 3rd(current) employer, i became out of status for a month, but i think it was not noticed during the H1 transfer. I got it smoothly in the premium process. Since then, now its 2.5 yrs. My existing visa got expired in 2007 itself, but have valid 797 petition.
Also, my labor was filed recently. Should i disclose that in the interview ? If so, i am thinking that officer could think that i am a possible immigrant and refuse the visa ?
Now with all this, Is it a good idea to go to India for vacation as my wife feeling too much home sickness. Or should i go to Canada ? Even my family needs visa renewal ? I plan to go all of us together.
What documents i should carry most importantly ?
any advice pls ?
