Visa Renewal..aos interview a problem?

My AOS interview is coming and was going through my stuff. I entered with a tourist visa in 1997 and continued to overstay. Now My dad decided to renew our visas so he sent it to his friend back home in the Philippines. Now When his friend sent it back he sent back our old original passport which was cut to deem in void along with our new passports with new visas. Now Looking at it closely, My first passport the one we used to enter the US has an arrival record back home. I guess the guy needed an arrival stamp in order to renew our visa. But now it looks as if i went back home, and entered illegally without getting inspected. I still have my original I-94 but since i never left but have an entry stamp from back home and I am here in the States it looks like i came without inspection and with no I-94...should i divulge this info or just keep it quiet. I renewed my passport via embassy and is asking me to surrender all passports...Should I wait till after the interview to surrender my passport or surrender it before the interview and just say that the embassy asked me to surrender them....Any help is appreciated.
 
Renew which visa? Surely it makes no sense to renew your US visa at this time.

Did you mean passport renewal, not visa renewal?
 
Im not planning on renewing my visa at this time. What i am asking is will that arrival stamp on my passport pose a problem for me during my AOS interview, considering that the stamp means that i went back to the Philippines which i didnt. and me being present here in the US can be interpreted as me coming here without inspection and no I-94...I renewed my Passport and the embassy is asking me to surrender my passport which has the stamps....if i do i can say that i dont have the passport anymore because the embassy asked me to surrender them...
 
I know exactly what you are talking about because a friend of mine did it way back then. The problem is that it is considered immigration fraud to have sent your passport back home to renew the visa when you were not there, especially since they fraudulently stamped an arrival in the Philippines. That will earn you a lifetime ban without a waiver if it is discovered.

I don't know what to tell you since I cannot give you criminal advice. I am not judging you but I think you can at this point only hope it is not detected.

That is some serious issues you dug yourself into and I strongly suggest you have legal advice on how to proceed.

Did u send copies of all these information with your applicaltions ?

If not .

I have seen some people here apply for I94 copies cause they lost theirs. That might work for you since it will get you copy of when you entered the first time. But I am sure that takes a abit of time to get and your interview is due real soon.

Were you a minor when this happened? You may be in luck if that is the case. :):):)

I dont know exactly when he did it i know that it was not on the same date as the arrival stamp back home but it was renewed in 2000 and i was 16 at that time...
