VISA Renew Question.

Hello,

My H1B VISA expired this month and my new H1B approved is valid till December ,03(complete 6 years in Jan 1st week,04) . Can I go to India in december and get my VISA stamped even though it is good only for two months or is it really risky to go to india at this time?

U can get it stamped in oct in India.
It takes 3 weeks for stamping and if u get a query it might be delayed more.
So, make sure u have ample time left, when u go to India for stamping.
 
Hi

As such there is no rule based on many months on I-797 there should remaining to get a Visa though your passport needs to be valid for atleast 6 months when you apply for a Visa.

Having said that I think you are cutting it too close since you have just couple of months looking at some of the issues that people are having(refer some of the other threads) there is big chance(my personal opinion note I am not a lawyer) that there could be issues.
