- My spouse went for H4 visa at US Chennai Consulate, they raised a query:
- Explain the H worker 2004 earnings if less than mandated by the LCA, please explain 30K instead of 45K in 2004
- My spouse visited again with my company’s explanation.
- For that explanation, INS queried again:
Please provide a signed, notarized letter from president of <company> USA explaining what training <name> was required to undertake in <city> during oct-nov 2004. please specify the nature of the training and why <name> was not paid while he was undergoing this training, as required by law
- For the above query, This is the explanation my company is giving:
<company> employs <name> as <designation>. Currently, <name> is deployed on an assignment in the United States and is working on H1B Visa.
<name> was instructed by our office to take part in necessary training in ISO 9001 certification during October 25th, 2004 to November 2nd, 2004 at our office located in <US address>. <name> is required to undergo this training to adopt and implement quality process in Software Engineering. But, during the same period, <name> had planned for an unpaid vacation to visit his home country, India. Since, the same training program is offered in our India office as well, <name> preferred to take this training program in our India office while he is in India on vacation. He has been deployed to <city>, India to undergo required training to adopt and implement quality process in Software Engineering along with the team consisting of 11 technical personnel. <company> received ISO 9001 Certification on November 26th 2004.
Since <name> requested for an unpaid vacation, he is not in United States from October 8th, 2004 to November 14th, 2004 and did not take training in our US office, we, in the US office considered this as an unpaid vacation period.
<name> is compensated in Indian Rupees by our office in India as he took part in training program in India.
This letter has been issued in clarification to our earlier letter dated <date> which might have caused some confusion. The above factors taken together will justify the reasons for <name> salary being lower than as warranted by the prevailing wages. We trust that this response addresses the issues raised in your letter.
We will appreciate if <name> spouse is granted H-4 Visa by your office under powers vested with you so that <name> family can be united.
If you have any further questions, <name>, our attorney may be contacted at 123-456-789
- This time it is drop box, and I am afraid if the above response solves the problem or does consulate ask for more queries.
- Please help me, I need your suggestions here. What possible quries consulate may ask further? What documents I may need to produce this time? (some say just address what they ask for, giving more information than they need may raise more queries). How long does it take for consulate to respond to drop box queries?
