Visa numbers

Hello Alren, Raju amd other CP Gurus -

We have been hearing that the visa numbers are likely to regress (ie no longer current) in Jan 2005 for EB2 and EB3 categories for residents of India, China and Phillipines.

1. I have read on this forum that a visa number is allocated once NVC transfers the case to the consulate. Is that correct?

2. My P3 was sent to NVC on 10/20/04. Will I get the visa nuber before Jan 05.

3. If the visa numbers are no longer current, any idea how long it will take before the visa numbers are current again? My labor was filed in 2001.

Only EB3 will probably be affected. EB2 won't be.
Here's what I've gathered so far. Even after the case goes to consulate they won't call you for an interview till your pd is current. Q2. who knows? Q3. In the past, the priority dates have swung wildly. sometimes going back a year or more and then becoming current suddenly. You seem to be well placed. My pd is Nov2002. :(

as this seems to be very important in terms of timing.
I hope if folks whose case have been sent to chennai consulate in October get scheduled in Nov/Dec then atleast we have a chance before the regress happens in January.

Here is MY take on the regress and I would be more than happy if someone disputes this :

By 'regress' what I understand is that the the quota for a specific category/country is full and the USCIS will wait till such time that the visa numbers are available. So in the case of I485 they would not even let you submit your forms till USCIS is ready to process your case. Extending the same logic in the case of a CP case, NVC will not even assign you the Case Number (which primarily starts with the 3 letter code of the consulate location you choose). So having a case number allocated itself means that NVC is ready to further process the case. Hence MY argument is that once NVC case number is allocated then regress does not apply.

Experts please comment on this.
 
Case Number is different to Visa Number . I think consulate requests for Visa Numbers every month for the candidates to schedule interview . Consulate will not arrange the interview till the case is not Current

I agree with you - what I am trying to say is the NVC will process the case only when visa numbers are current - otherwise they are going to put it on hold till the visa number becomes current. Any thoughts???

I think what you are tying to say is that the consulate will request for visa numbers for everymonth during the previous month. Only on receipt of the visa numbers do they publisht the interview dates which they do normally during the second week of the month for the next month.

The case is very similar

INS will process or accept I-1485 if the visa numers are available .Suppose someone has submitted the I-1485 and dates retrogress they will not process the case as they will need visa number

As in our cases NVC has processed the case as at this stage visa numbers are current but not alloted .

At the last phase of interview Consulate will request for Visa number and then schedule the interviw

This is my understanding
 
What does cut off date 2002 mean ? Will they consider priority dates till 2002 ? or 2001 ?

Mine is EB3 . Priority date is Sep 2002.
 
A few questions

My Labor App was filed in NYC on 10th July 2001.So I consider that my priority date ??

IS that a correct assumption ??

Next question is since my spouse's name was not on the I-140 and we will be applying for a separate fee receipt would it change the PD for any of us.

Also assuming that the PD will regress to say Jan 2002 does it mean that my case will continue to be processed ??
