Visa Number Request against Labor Approval or I140 Approval??

Hello Folks:

How are the Immigrant Visa Numbers are requested and how do they know what Category E37/39 or E21/E26 should they request and how is it determined? Is it determined on Labor Approval Notice or I140 Approval.

What category will they pick if the Labor Application is Approved in EB3 and it is bumped from EB3 to EB2 at I140 Stage and applied in EB2 and got the approval notice in EB2 with 203 (b) 2 Member of Exceptional Ability with Advanced Degree? What will they look at the time of immigrant visa request from DOS?

I think E category starts from labor itself.

I'm not sure of your second part of your question. Many of them even god himself( herself) cannot answer. USCIS & DOS has some Einsteins deciding it :) :)
 
I think there is no serial#s for visa. They just keep count. So it doesn't matter. Only when the case becomes 'approvable' will they check for count(*) for that category.

June1506, yes there are categories for visa numbers and they count visa numbers against that pool.

I could be wrong but to the best of my knowledge
EB3 has some job description and some wage level according to state wages.
EB2 has higher job desc/resp and higher wage level. A case which can be qualified as EB3 may not be qualified as EB2. But EB2 could be qualified as EB3 too... I think some lawyers do it for more flexibility.
