Visa Number and Priority dates

Some one Please help me in understanding this - for any EB3 from etrogressed State.

One can only apply for 485 when Visa number is availiable... And 485 might be approved only after the Priority dates becomes current. -------------------------------------------------------------------------------------------
People who have concurrently applied will have to wait till there Priority dates become current. -------------------------------------------------------------------------------------------
So let say in the month of OCT they release new Visa Number -- say they allocate 100 visa numbers for EB3.

Now say when visa number becomes availiable .. every one with approved 140 will start applying ...

Que 01 : Will the USCIS stop accepting applications (485) when 100 applications are already received.

Que 02 : Since they have already pending 485 .. which was concurrently applied ... Will all the visa number go to them first ..?

Que 03 : Can there be a situation where all the visa number be consumed by the concurrent guy and they will not accept new applications?

Que 04 : Is Visa number alloted FIFO basis?

Whoa -- I think you are over-complicating a simple process.

Visa numbers are allocated about 15 days in advance and they are always for the entire month.
So around Sep 15th, State dept will give EB3 visa numbers. By "giving" visa numbers, I mean that the EB3 category will no longer be "unavailable" - instead a cutoff PD would be established.

Just for argument sake, lets assume that the new cutoff PD (for Ind/China etc) is set to Sep 1st, 2002.

If your PD is before that date, you can apply for 485 ANYTIME till end of October. Doesn't matter if 100,000 people apply in that month - they won't close it mid way in Oct.
What they'll do if they get way too many applications, is that they will retrogress it further for the next month -- so beginning Nov 1st, you may or may not be able to apply depending on the new cut-off dates.

The decision to set a date is made after taking into account pending applications, the expected demand for numbers etc etc .... that's the reason why it never moves in certain months.

btw, what's your PD ??

Visa numbers are supposed to be consumed in the order of your PD -- so its kinda FIFO -- but with everything USCIS, cases always jump around - so its your luck too :D

EB3 filers, take a break. Go on vacation till the last week of Sep. That is when the visa bulleting is going to give us another shocker.
